2023-17 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF VERMILION, OHIO TO ENTER INTO A CONTRACT WITH HERK EXCAVATING, INC. OF VERMILION, OHIO FOR THE MINNIE WAWA STREET SANITARY SEWER AND WATERMAIN REPLACEMENT PROJECT IN THE CITY OF VERMILION, OHIO; AUTHORIZING THE FINANCE DIRECTOR TO MAKE PAYMENT TO SAID AWARDEE IN AN AMOUNT NOT TO EXCEED $________________ AND DECLARING AN EMERGENCY.
WHEREAS, on February 23, 2023 and March 2, 2023, bids for said improvements were duly advertised in the Vermilion Photojournal and,
WHEREAS, on March 16, 2023, bids for said improvements were received and duly opened by the City Engineer and,
WHEREAS, this City Council deems Herk Excavating, Inc. of Vermilion, Ohio to be the lowest and best bid,
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:
SECTION 1: That the bid submitted by Herk Excavating, Inc. of Vermilion, Ohio for the Minnie WaWa Street Sanitary Sewer and Watermain Replacement Project in the City of Vermilion is hereby accepted.
SECTION 2: That the Mayor be and hereby is authorized and directed to make and enter into a contract with Herk Excavating, Inc. of Vermilion, Ohio for the Minnie WaWa Street Sanitary Sewer and Watermain Replacement Project on behalf of the City of Vermilion, Ohio in an amount not to exceed $____________ .That the abovementioned contract will be made in strict accordance with the specifications and the bid; the same to be considered a permanent part thereof as though fully rewritten therein.
SECTION 3: That the awardee herein shall furnish to the prevailing wage officer of the City of Vermilion, Ohio, to wit, the Director of Finance, a statement to the effect that all laborers have been paid a minimum of the prevailing wages established by the US Department of Labor, Davis Bacon wage rates, for the County in which the work is performed, together with such other payroll information and wage documents that shall be required.
SECTION 4: This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
SECTION 5: That this Ordinance is declared to be an emergency to proceed with the project for the public peace, health, and safety of the city; the emergency being the necessity of starting this project during the spring season. Wherefore, this Ordinance shall take effect immediately upon its passage and approval of the mayor, providing it meets the statutory requirements for passage; otherwise, it shall take effect and be enforced from and after the earliest period allowed by law.
