2023-68 AN ORDINANCE CONFIRMING THE APPOINTMENT BY THE MAYOR AND THE VERMILION PARKS AND RECREATION BOARD OF CHAD KUHNS AS RECREATION DIRECTOR TO THE CITY OF VERMILION FOR THE 2024 RECREATIONAL PROGRAMS; ESTABLISHING A SALARY FOR SUCH APPOINTEE; ESTABLISHING COMPENSATION OF CERTAIN AUTHORIZED POSITIONS WITHIN THE VERMILION DEPARTMENT OF PARKS AND RECREATION AS HAVE BEEN FAVORABLY RECOMMENDED BY THE CITY’S PARKS AND RECREATION BOARD AND DECLARING AN EMERGENCY.
WHEREAS, the Charter of the City of Vermilion provided that the mayor shall be the appointing authority within all departments of the City; and,
WHEREAS, it is necessary for this Council to approve the appointment of the Recreation Director as provided in Section 244.01 of the Codified Ordinances of Vermilion, and
WHEREAS, it is further provided that said Director shall serve at the pleasure of the mayor,
NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Vermilion, Counties of Erie and Lorain, State of Ohio:
SECTION 1: That this Council hereby approves the appointment by the Mayor and the Parks and Recreation Board of Chad Kuhns to act as Recreation Director of the City of Vermilion, the salary for which will be established through appropriation of City Council not to exceed Eleven Thousand Five Hundred Dollars ($11,500) annually to be paid in accordance with the practices of the Finance Department of the City of Vermilion. The last paycheck following the completion of any recreation season will be held until the final report for that activity has been submitted and approved by the Chairperson of the Parks and Recreation Board.
The Parks and Recreation Board defers, directs, and authorizes the Service Director to oversee the supervision of this position and its subordinate responsibilities regarding routine, daily operational and maintenance activities necessary to administer and manage the program on the Board’s behalf, provided that the Board is kept apprised through status reports at regular intervals throughout the year.
SECTION 2: That there is hereby established up to four (4) Assistant Directors of 2024 Summer Recreation whole salaries shall not exceed Five Thousand Dollars ($5,000) per season.
That the Vermilion Parks and Recreation Board, upon the recommendation of the Recreation Director and Service Director are hereby authorized to employ a head maintenance person, whose salary is based on the current minimum wage rate, plus $2.50, and two (2) assistant maintenance personnel, whose salary shall be based on the current minimum wage rate. That the Recreation Director, upon the recommendation of the Parks and Recreation Board, may employ a head umpire at a rate not to exceed Five Hundred Dollars ($500.00) for the season. Compensation for youth baseball umpires shall remain within the rate schedule of Ten Dollars ($10.00) to Fifty Dollars ($50.00) per umpire per game as determined by the Parks and Recreation Board.
SECTION 3: That there is hereby established up to two (2) Assistant Directors of youth football for the 2024 season and they shall be paid in an amount not to exceed One Thousand Dollars ($1,000) per season. That the Vermilion Parks and Recreation Board, upon the recommendation of the Recreation Director, are hereby authorized to employ qualified referees to implement said program whose salary shall range from Ten Dollars ($10.00) per game to Forty Dollars ($40.00) per game as established by the Parks and Recreation Board.
The Vermilion Parks and Recreation Board upon the recommendation of the Recreation Director are hereby also authorized to employ qualified score keepers and game officials to implement said program, whose salary shall be based on the current minimum wage rate. That the Parks and Recreation Board, upon the recommendation of the Recreation Director, may employ a cheerleading advisor at the rate of Three Hundred Dollars ($300.00) for the 2024 football season.
SECTION 4: That there are hereby established up to four (4) Assistant Directors of youth basketball for the 2024 season and they shall be paid in an amount not to exceed One Thousand Five Hundred Dollars ($1,500). That the Vermilion Parks and Recreation Board, upon the recommendation of the Recreation Director, are hereby authorized to employ qualified referees to implement said program whose salary shall range from Ten Dollars ($10.00) per game to Thirty Dollars ($30.00) per game as established by the Parks and Recreation Board. The Vermilion Parks and Recreation Board upon the recommendation of the Recreation Director are hereby also authorized to employ qualified score keepers and game officials to implement said program, whose salary shall be based on the current minimum wage rate. That the Parks and Recreation Board, upon the recommendation of the Recreation Director, may employ a cheerleading advisor at the rate of Three Hundred Dollars ($300.00) for the 2024 basketball season.
SECTION 5: For any other recreational activity sponsored by the Vermilion Parks and Recreation Department that is not listed above, the Recreation Director shall be paid on the following terms:
Any recreation activity sponsored by the Vermilion Parks and Recreation Department and approved by motion of the Board, shall be funded as follows:
All revenue raised for such activity will first be submitted to the Department of Finance for collection. All expenses and officials’ salaries will be paid from the revenue raised by the individual activity after authorization of the Chairperson of the Recreation Board. After all revenues and expenses are paid for such recreational activity, said Recreation Director shall then receive a percentage of the balance of the funds collected at an amount established by a motion of the Parks and Recreation Board and approval of the mayor.
SECTION 6: That all appointments referred to herein shall be considered part-time personnel of the city of Vermilion and shall be within the non-classified, non-competitive service and shall receive no fringe benefits.
SECTION 7: This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public and in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
SECTION 8: That this Ordinance is declared to be an emergency for the public peace, health, and safety of the City; wherefore, this Ordinance shall take effect immediately upon its passage and approval of the mayor, providing it meets the statutory requirements for passage; otherwise, it shall take effect and be enforced from and after the earliest period allowed by law.
